Welcome to Move With Peace of Mind (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of https://movewithpeaceofmind.com (the “Site”), our booking forms, communications (including SMS), and our moving, packing, and logistics services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
1) Services
We provide residential and commercial moving, packing, storage coordination, and logistics. You agree to provide accurate information, ensure safe access for crews, and comply with pre-move prep instructions. Estimates are based on info provided and may change due to actual inventory, access, or conditions.
2) Eligibility
You must be at least 18 and able to enter a binding contract. If you book on behalf of another party or entity, you represent you are authorized to do so.
3) Quotes, Booking & Payments
- Estimates: Non-binding unless expressly stated. Additional labor, packing, materials, stairs, long carries, or delays may incur charges.
- Deposits: A non-refundable deposit may be required to secure your date. Applied to final invoice.
- Reschedules/Cancellations: Please provide at least [48] hours’ notice. Late cancellations may forfeit the deposit and/or incur a fee.
- Payment Methods: We accept [list methods]. Balances are due upon completion unless otherwise stated.
4) Prohibited Items
We do not transport hazardous materials, explosives, illicit goods, perishable or live items, or items prohibited by law. We may refuse items deemed unsafe.
5) Damage, Claims & Limitations
- Standard valuation: Unless you purchase additional protection, standard valuation limits liability per pound per article as allowed by applicable law.
- Claims: You must note visible damages at job completion and submit any claim in writing within 15 days to claims@movewithpeaceofmind.com.
- No liability for: Pre-existing damage, inherent vice, normal wear, customer-packed boxes, particle board furniture, or consequential damages.
6) Messaging & SMS Terms (A2P/10DLC)
By providing your phone number on our Site, during booking, or by texting our number, you consent to receive SMS from Move With Peace of Mind. Messages may include confirmations, reminders, service updates, and promotions.
- Opt-out: Reply STOP to unsubscribe at any time. For help, reply HELP.
- Frequency: Varies by interaction. Message & data rates may apply.
- Vendors: We use trusted providers (e.g., GoHighLevel/Twilio) to deliver messages.
- Consent: Website forms include an unchecked checkbox clearly stating SMS consent (see our Privacy Policy).
7) Acceptable Use
Do not misuse the Services, interfere with operations, or attempt unauthorized access. We may suspend or terminate access for violations.
8) Intellectual Property
All Site content is owned by the Company or its licensors and protected by law. You may not copy, distribute, or create derivative works without permission.
9) Disclaimers
The Services are provided “as is.” We do not warrant uninterrupted or error-free operation. Scheduling may change due to events beyond our control.
10) Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the amount you paid for the applicable Service or the valuation election you selected, whichever applies. We are not liable for indirect, incidental, special, or consequential damages.
11) Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising from your misuse of the Services or breach of these Terms.
12) Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflicts of laws. Venue and jurisdiction lie in the state and federal courts located in Palm Beach, FL, unless a separate written service agreement states otherwise.
13) Changes to Terms
We may update these Terms from time to time. We will post the new Effective Date and, where required, notify you.
